This notice is issued by mycashless, Inc., including its affiliates and subsidiaries (“mycashless”), the legitimate owner of the software known as “mycashless” or “Cashless®” (“Platform” or “Software”), located at 1017 Montana Ave, El Paso, TC, 79902, with the website www.mycashless.com (the “Site”) and email [email protected] (the “Email”). This policy informs any person who accesses or uses the Site (“User”) about the use of cookies by mycashless on the Site.

The term “cookies” refers to small files typically consisting of letters and numbers placed on your computer, tablet, phone, or similar device used by the User to access the Site. The term also encompasses similar technologies such as pixel tags, web beacons, clear GIFs, JavaScript, and local storage (“web beacons”), which may be associated with the Site.

Accessing and/or using the Site implies full acceptance of the terms contained herein. Therefore, it is the sole and exclusive responsibility of the User to read this cookie policy and its corresponding updates each time they access the Site. mycashless, as the operator of the Site, may place cookies on the device through which the User accesses it. These cookies are called “first-party” cookies. Cookies set by service providers that offer services through the Site, such as email, are called “third-party” cookies. mycashless does not control the use of this technology or the resulting information and is not responsible for any actions or policies of these third parties.

mycashless informs the User that, through cookies, it is possible to obtain and use aggregated and other types of NON-IDENTIFYING information about individual users (such as their operating system, browser version, and the URL of the source, including emails and advertisements) to enhance their experience and understand traffic patterns. This technology is used as a tool to compile aggregated statistics about the use of the Site for analysis and performance and optimization of the same.

mycashless states that it may also use similar technologies, such as web beacons (sometimes called “tracking pixels” or “clear GIFs”). These are very small graphic files that contain a unique identifier that enables the recognition of a visit to the Site or notifies mycashless when the User opens an email sent by mycashless. Generally, these technologies rely on cookies to function correctly, thus reducing them directly affects their operation.

Types of Cookies  

mycashless and its service providers may use one or more of the following types of cookies:

• Essential Cookies: Necessary for the operation of the Site, allowing the User to navigate and use its features (e.g., to allow the User to log in to secure areas of the Site or use a shopping cart). Disabling these cookies may impair the performance of the Site and possibly make the features of the Site and its service unavailable.
• Analysis and Personalization Cookies: Designed to analyze the User’s activity on the Site and/or on sites where mycashless publishes or promotes content, these cookies are used to ensure that the User can find the information they seek on the Site more easily. They allow for the recognition and counting of visitors to the Site and measuring the performance of advertising campaigns and content optimization by mycashless.
• Functionality Cookies: Used to recognize the User when they enter or return to the Site, by personalizing content, using the registered name as User, and preferences such as language, region, etc.
• Advertising Cookies: These cookies are used to highlight content on the Site that is most relevant to the User, based on apparent interests collected according to their online activity, including visits to the Site, pages visited, and selection of links and ads. Through the use of data management and editing platforms, advertisements on the Site owned by mycashless or on any other are linked, with the aim of maintaining continuous promotion of products and services visited on the Site.

The use of cookies allows mycashless, and its service providers, to collect certain sensitive data from the User to i) obtain information about their visits to the Site; ii) process the User’s orders; iii) analyze their visit patterns for the Site improvements; iv) offer advertising, communications, and content from mycashless and third-party allies on the Site and on third-party sites that are specific in relation to their interests; v) remember the language and other preferences of the User; vi) help the User obtain the information they seek; vii) provide a secure service for online transactions; viii) quantify the access and use of the Site; ix) offer efficient functionality in accordance with the audience of the Site, among others.

Types of Cookies Regarding Their Permanence in the System  

Cookies on the device used to access the Site can be:

• Session cookies: which are activated at the time of accessing the Site and until the end of that session. These cookies expire and are automatically deleted when the internet browser is closed; or 
• Persistent cookies: which remain on the access device between browsing sessions. The duration that a persistent cookie remains on your device varies from one cookie to another.

The purpose for which mycashless uses cookies is: i) to store User preferences, in order to keep them available for their next visit; ii) to maintain information on frequency and variation in visit time to the Site; and iii) to test the effectiveness of advertising efforts.

User Cookie Management  

The User, through their internet browser settings, can decide whether to accept cookies from the Site. mycashless states that blocking all cookies by the User may cause blocking or total or partial impairment in the access and use of the Site.

mycashless commits to the proper use of personal and sensitive data provided by the User, and will do so in accordance with the Privacy Notice found on the Site. Any questions or comments regarding the use of cookies by mycashless can be directed to the Email. In such cases, please include contact information, the name of the mycashless website, and a detailed description of the request or concern related to cookies.

Acceptance of Terms

The User acknowledges that by accessing and using the Site, they express their full and unreserved acceptance and, therefore, their adherence to the version of these terms published at the time they access the Site. It is the sole and exclusive responsibility of the User to read these terms and their corresponding modifications each time they access the Site. If, at any time, the User does not agree, in whole or in part, with the present terms, they must immediately refrain from accessing and using the Site. Therefore, by accepting these terms, the User expressly consents to be bound by them, thereby declaring that they have read the contents of each provision and ratify their content.

Complete Agreement

The User acknowledges and accepts that mycashless has made all the information necessary to understand the scope and characteristics of the Site available to them. Similarly, the User states that, prior to accessing the Site, they analyzed its features and, consequently, agrees with them.
