This Privacy Policy (“Policy”) describes how we collect, use, disclose, share, and safeguard information about you when you visit our website at mycashless.com (the “Site”), download or use our mobile application (the “App”), or otherwise engage with our cashless® software platform (the “Platform”) and related services (collectively, the “Services”).
This Policy applies to users located in the United States. If you reside outside the United States, additional or different terms may apply under local law.

The categories below are illustrative and not exhaustive; the specific data elements collected depend on how you interact with the Services and the profile under which you register.

- Balance, top-ups, consumption, payments, refunds, and movements made within the Platform;

- Identification of events, venues, establishments, points of sale, or vendors where transactions take place;

- Linkage with payment methods, wristbands, chips, cards, devices, or unique identifiers enabled by the Platform;
- Records of access control, including tickets used for event entry and entry/exit times;
- Customer service, support, claims, and other communications with you.
D. Device, Technical, and Usage Data
Information automatically collected from the devices you use to access the Services, including:
- Device type, operating system, and version;
- Device or browser identifiers (device ID, session ID, cookies, and similar technologies);
- IP address;
- Connection information, date and time of access;
- Technical logs necessary for security, fraud prevention, and the correct functioning of the Platform.
E. Aggregated and De-Identified Data
We may generate and process aggregated, de-identified, or anonymized data derived from your use of the Platform. Once data has been irreversibly de-identified so that it can no longer reasonably identify, relate to, or be linked to you, it is not treated as Personal Information under this Policy and may be used for statistical, analytical, operational, product development, and business improvement purposes.
F. Accuracy of Information
mycashless does not operate as a verification, registration, or computation unit of the information that users, clients, or commercial partners submit. The Platform processes the data as provided through the applicable forms. mycashless does not independently validate the accuracy or truthfulness of information you submit and assumes such information to be true, complete, and correct. You are responsible for the accuracy of the information you provide; if you submit false, inaccurate, or altered data, mycashless will not be liable for any resulting incorrect processing or related damages, to the maximum extent permitted by applicable law.
3. How We Collect Your Data
A. Directly From You
When you register on our Site or App, create a user profile on the Platform, subscribe to communications, complete a physical or electronic form or survey, contact customer support, or otherwise voluntarily provide information.
B. Automatically From Your Devices
When you interact with the Site, App, or Platform, we automatically collect technical and usage information through cookies, SDKs, log files, and similar technologies, including IP address, device information, and browsing behavior.
C. From Third-Party Platforms
Where you elect to do so, you may authorize the use of information held by third-party platforms (for example, Google) by connecting through their APIs (Application Programming Interfaces) rather than entering data manually. Use of those APIs is conditioned on your prior registration with that third party. Information obtained through these third-party platforms is also subject to those third parties’ own terms and privacy notices. D. App Downloads
The App is made available for download through third-party platforms such as the Apple App Store and the Google Play Store. mycashless is not responsible for the processes those platforms follow. You are solely responsible for complying with the terms of those platforms and for understanding how those platforms process any data you provide in order to download the App to your device.
4. Cookies and Similar Technologies
mycashless uses cookies and similar technologies to deliver the best possible experience on the Platform, including by remembering your service and marketing preferences and helping you find relevant information. 5. How We Use Your Information
We use Personal Information, including transactional data linked directly or indirectly to your account, for the following business and commercial purposes:
- To establish, operate, administer, and maintain your account and the Platform;
- To provide and maintain the Services, including reflecting balances, top-ups, consumption, payments, refunds, and movements made within the Platform;
- To enable Platform features, including recommendations, content, and personalized experiences based on your behavior, usage history, preferences, interactions, and consumption patterns within the Platform;
- To improve, develop, and optimize our Services, products, and user experience;
- To communicate with you, including service notices, security alerts, updates, customer support, and (where permitted) marketing and promotional materials;
- To maintain operational and transactional records for traceability of operations;
- To protect the security of operations, prevent fraud, abuse, and misuse of the Platform;
- To perform analytics and gather demographic information for market analysis and business intelligence;
- To comply with our legal, tax, regulatory, and contractual obligations, resolve disputes, and enforce our agreements;
- For any other purpose disclosed at the time of collection or to which you consent.
Where transactional data is used for analytical, statistical, business intelligence, development, or service-improvement purposes, we will, when technically and operationally feasible, process such data in aggregated, de-identified, or anonymized form. Aggregated or de-identified data does not affect your rights under this Policy.

A. Service Providers and Processors
Vendors and contractors that perform services on our behalf, including hosting, infrastructure, payment processing, fraud prevention, analytics, customer support, communications, and operational support. These providers are authorized to use your Personal Information only as necessary to provide their services to us and in accordance with our instructions.
B. Organizers, Hosts, and Vendors
Event organizers, venues, hosts, and vendors (collectively, “Commercial Partners”) that sell products or services to you through the Platform or that operate events, communities, or experiences in which you participate. Depending on the activity, Commercial Partners may act as independent controllers or as our processors with respect to the information they receive. They are limited to processing only the information strictly necessary to operate their event, community, or service.
C. Affiliates and Related Parties
Our parent, subsidiaries, affiliates, and other related entities, for purposes consistent with this Policy.
D. Legal, Compliance, and Safety
Government authorities, regulators, law enforcement, courts, or other third parties when we believe in good faith that disclosure is necessary to comply with law, respond to legal process, enforce our agreements, or protect the rights, property, or safety of mycashless, our users, or the public.
E. Business Transfers
In connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of all or a portion of our assets, or similar transaction, in which Personal Information may be transferred or disclosed as part of the transaction.
F. With Your Consent or at Your Direction
Any other party when you direct us to share your information or otherwise consent to the sharing.
mycashless does not “sell” your Personal Information in exchange for monetary consideration. To the extent any sharing of Personal Information for cross-context behavioral advertising or other purposes would be considered a “sale” or “sharing” under applicable U.S. state privacy laws, you have the right to opt out as described in Section 7.
We require our recipients to maintain appropriate administrative, technical, and physical safeguards to protect your Personal Information and to use it only for the purposes for which it was disclosed.
7. Your Privacy Rights
Depending on your state of residence and applicable law (including the California Consumer Privacy Act/California Privacy Rights Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and similar laws in other U.S. states), you may have some or all of the following rights with respect to your Personal Information:
Right to Know / Access: Request confirmation of whether we process Personal Information about you and obtain a copy of the categories and specific pieces collected, the sources, the purposes, and the categories of recipients.
Right to Correct: Request that we correct inaccurate or incomplete Personal Information we hold about you.
Right to Delete: Request that we delete Personal Information we have collected about you, subject to certain legal exceptions.
Right to Opt Out of Sale or Sharing: Opt out of the “sale” or “sharing” of Personal Information for targeted advertising or cross-context behavioral advertising.
Right to Limit Use of Sensitive Personal Information: Where applicable, direct us to limit the use or disclosure of sensitive Personal Information.

To help us respond, please include: (a) your full name and a means of contacting you; (b) information sufficient for us to verify your identity (and, where applicable, the identity and authority of any authorized agent); (c) a clear description of the Personal Information involved and the right you wish to exercise; and (d) any other information that would help us locate the requested data.
We will respond to verifiable requests within the timeframes required by applicable law. You may also contact us to obtain more information about the status of your request or the procedures available to you.
These rights do not apply to information that has been de-identified, aggregated, or anonymized in such a way that it cannot reasonably be associated with you.
8. Withdrawing Consent; Limiting Use and Disclosure
Where we rely on your consent to process Personal Information, you may withdraw your consent at any time, and you may request that we limit the use and disclosure of your Personal Information, subject to any legal restriction that requires continued processing. To do so, submit a written request to [email protected], following the same procedure described in Section 7.
Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal. Where your Personal Information has been transferred to a processor before you withdraw consent, we will notify the processor so that it can take the appropriate action.
9. Data Retention
We retain Personal Information for as long as necessary to fulfill the purposes described in this Policy, to maintain the operational and transactional records of the Platform, to comply with our legal, tax, accounting, and regulatory obligations, to resolve disputes, and to enforce our agreements. When the purposes for which Personal Information was collected have been fulfilled and no legal obligation requires its preservation, mycashless will cancel, delete, or destroy the Personal Information in accordance with applicable law.
10. Security of Your Personal Information
mycashless implements reasonable administrative, technical, and physical safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
11. Children’s Privacy
The Services are not directed to children under the age of 16, and we do not knowingly collect personally identifiable information from children under 16. We do not knowingly sell or share the Personal Information of consumers under 16 years of age. If we become aware that we have collected Personal Information from a child under 16 without verified parental consent (or, where applicable, the consent of the minor between 13 and 16), we will take appropriate steps to delete it. The Services may contain links to, or be integrated with, third-party websites, services, and platforms that are not owned or controlled by mycashless. 13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time at our discretion. The updated version will be indicated by an updated “Effective Date” at the top of this Policy and will become effective when posted on the Site or otherwise made accessible. Where required by law, we will provide additional notice (for example, by email or through a notice in the App or Site). We encourage you to review this Policy periodically.
14. Digital and Electronic Acceptance
You acknowledge and agree that your acceptance of this Policy and your use of the Services may be expressed through electronic means, including by accessing or using the Site, App, or Platform, registering for an account, or providing your Personal Information through the Platform, without the need to physically sign any document. Electronic records and acceptance shall have the same legal effect as a handwritten signature to the extent permitted by applicable law.
